General Terms and Conditions Guesthouse

The following terms and conditions apply to the provision of hotel rooms and all other services provided to the customer by Gästehaus Villa Hochdörffer (hereinafter referred to as the hotel):

I. Conclusion of Contract, Termination, Withdrawal, Cancellation of the Hotel Accommodation Contract

1. The hotel accommodation contract is concluded upon written/email confirmation of a booking by the hotel.

2. If the contract is terminated in whole or in part by the customer through cancellation, the hotel must give its consent.

3. If the hotel does not accept the termination of the contract, the hotel will endeavor to re-let the room(s). If the hotel is unable to do so, payment of the agreed price for accommodation/breakfast for the contractual period will be due. Unless otherwise agreed (only in writing), the following cancellation conditions apply:

Up to 31 days before arrival: free of charge

30 to 21 days before arrival: 40% of the agreed price

(accommodation only, without breakfast)

20 to 8 days before arrival: 60% of the agreed price

(accommodation only, without breakfast)

From the 7th day before arrival: 80% of the agreed price

(accommodation only, without breakfast)

From 24 hours before arrival or without cancellation, the full agreed price is due.

This policy also applies if the number of rooms booked and/or the length of stay is reduced. The customer is, of course, entitled to prove to the hotel that the actual damage was less or that no damage occurred at all.

4. The hotel is entitled to withdraw from the contract for objectively justified reasons.

For example, if force majeure or other circumstances beyond the hotel’s control make fulfillment of the contract impossible, if rooms were booked under misleading or false information regarding essential facts, e.g., the hotel guest or the purpose, or if the hotel has reasonable grounds to believe that the use of the hotel services could jeopardize the smooth operation, security, or reputation of the hotel. If the hotel’s withdrawal is justified, the customer is not entitled to compensation.

II. Arrival and Departure

1. The hotel is obligated to make the reserved rooms available from 3:00 PM on the day of arrival. Whenever possible, rooms will be made available earlier if necessary. There is no entitlement to earlier handover.

2. Unless otherwise agreed, the hotel will hold reserved rooms until 6:00 PM. For guaranteed bookings via HRS, the reservation must be made available until 8:00 PM. After that, the hotel is free to allocate rooms to other guests. Arrivals after 8:00 PM must be arranged in advance. In this case, we charge €10.00 for each hour of late arrival.

3. Booked rooms are available to the guest until 11:00 AM on the day of departure. If the guest leaves the room after 11:00 a.m., the hotel may charge an additional 50% of the room rate for that day if the room is available until 4:00 p.m., and 100% of the room rate for that day after 4:00 p.m.

4. For late departures without prior notice, an additional €10 will be charged for each hour or part thereof.

III. Price Increases, Payment, Place of Performance

1. The agreed prices include statutory VAT.

2. The hotel is entitled to demand payment upon arrival in the amount contractually agreed upon. Normally, however, the room is charged upon departure and must be paid immediately in cash or by EC/Visa/Mastercard.

3. In the event of late payment, the hotel is entitled to charge interest on the outstanding invoice amount at a rate of 5% above the current base interest rate of the Deutsche Bundesbank.

4. The customer may only offset or reduce a hotel’s claim if the claim is undisputed or legally binding.

5. The place of performance and payment is the registered office of the booked hotel.

IV. Third-Party Services

In addition to the hotel services, third-party services may be arranged for the customer, e.g., carriage rides, visits to events, excursions, etc. Third-party services are not provided by the hotel, but by third parties (service providers) under their own responsibility.

V. Liability / Limitation Period

1. The hotel is liable for its own services within the framework of the statutory provisions. Claims for damages arising from positive breach of contract, negligence upon conclusion of the contract, and tortious acts against both the hotel and its staff are limited to damages caused intentionally and through gross negligence.

2. If the customer does not reserve the entire number of rooms at the hotel, they cannot claim the use of specific hotel rooms and/or premises.

VI. Final Provisions

1. For any disputes arising from this contract and its fulfillment, the jurisdiction of the court having jurisdiction over the registered office of the hotel is agreed, to the extent permitted by law.

2. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. Otherwise, the statutory provisions shall apply.
